Laws to Protect Patients from Surprise Medical Bills
What is a Surprise Medical Bill?
When you go to an in-network hospital, but the doctor the or the machine or, anesthesiologist was out of network. These are surprise bills.
This happened when private equity bought up emergency rooms. They made this billing out of network person as a part of their business model: 1 in 5 ER visits resulted in these surprise medical bills.
In 2022 the No Surprises Act went into effect and stipulated that:
- Even if the ER you go to is out of network, you don’t have to pay the out of network fee.
- If an out of network doctor treats you at in network hospital they are not allowed to bill you out of network. And if there is a disagreement between your provider and the insurance company, they have to go to arbitration, you are not supposed to be involved in it. And this applies to all areas of healthcare. Air ambulance, ground ambulance, ER departments.
One bad thing to get around this law, the private equity firms will say what you visited them for was not an emergency and what is considered an emergency is up to them
What to say to them: We will not be paying that bill because of the No Surprises Act.
This is in violation of the No Surprises Act. We will be filing a complaint with the department of Health And Human Services to investigate this hospital’s billing practices if you do not correct the bill. They should say they will call your insurance and take care of this right away.
